Terms of Service
These Terms of Service ("Terms") govern your use of the Apex Aerial Inspections website and the drone inspection and aerial survey services provided by Apex Aerial Inspections Inc. ("Apex", "we", "us", or "our"). By using this website or engaging our services, you agree to these Terms.
01 Our services
Apex provides drone-based inspection and aerial survey services — including roof, tower, solar, facade, and 3D site surveys — together with imagery, reports, and related deliverables, flown under Transport Canada RPAS Advanced operations. The specific scope of any engagement is set out in the written quote we confirm with you.
02 Estimates & quotes
The online estimator is non-binding. The range it produces is an indicative, automated estimate for planning only — it is not an offer, contract, or guaranteed price.
A binding price applies only once we confirm a firm written quote, typically within one business day of your request. Quotes are valid for 30 days unless stated otherwise and assume the site conditions, size, and access described in your request. If actual conditions differ materially, we may revise the quote before proceeding.
03 Scheduling, access & client responsibilities
You agree to:
- Provide accurate site information, access, and any necessary permissions to fly over and document the property;
- Confirm that you own the site or are authorized to commission its inspection;
- Disclose known hazards, restrictions, or sensitive areas in advance;
- Ensure a safe operating area is available at the scheduled time.
You are responsible for obtaining any private permissions required from owners, tenants, or neighbours. Apex is responsible for required aviation authorizations (such as airspace authorization) for the operation.
04 Weather, airspace & rescheduling
Drone operations depend on safe weather and legal airspace conditions. We may delay, reschedule, or cancel a flight when weather, airspace restrictions, equipment, or safety considerations require it, at no penalty to either party. We will work with you to find the next suitable window.
05 Payment
Unless otherwise agreed in writing, invoices are due within 15 days of delivery. We may require a deposit for larger engagements. Late amounts may be subject to interest at the rate stated on the invoice. Deliverables may be withheld until payment is received in full.
06 Cancellation
You may cancel or reschedule a confirmed booking by giving us reasonable advance notice. Cancellations made on short notice, or after we have mobilized to site, may be subject to a fee covering our costs. Any specific cancellation terms for your engagement will be stated in your quote.
07 Deliverables & intellectual property
On full payment, you receive a licence to use the final reports and imagery we deliver for your own business and property purposes. Unless otherwise agreed, Apex retains ownership of its underlying methods, templates, and raw capture data, and may retain copies for its records and for legal, insurance, and quality purposes. We will not publicly publish identifiable imagery of your site for marketing without your consent.
08 Disclaimer & limitation of liability
Our reports are visual documentation, not engineering certifications. An Apex inspection records observable conditions at the time of flight. It is not a structural, engineering, or warranty certification, and does not guarantee that all defects have been detected.
Our services are provided with reasonable skill and care, but to the maximum extent permitted by law they are provided "as is" without further warranties. You remain responsible for decisions you make based on our deliverables and, where appropriate, should obtain professional engineering or trade advice. To the maximum extent permitted by law, Apex's total liability arising from any engagement is limited to the fees you paid for that engagement, and we are not liable for indirect, incidental, or consequential losses. Nothing in these Terms limits liability that cannot be limited by law.
09 Insurance
Apex maintains commercial drone liability insurance. Proof of coverage is available on request for an engagement.
10 Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
11 Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be subject to the courts of Ontario.
12 Changes to these Terms
We may update these Terms from time to time. The "Effective" date above reflects the latest version, and the version in effect when you engage us governs that engagement.
